Background While prenatal surgery historically was performed exclusively for lethal conditions, today intrauterine surgery is also performed to decrease postnatal disabilities for non-lethal conditions. We sought to describe physicians' attitudes about prenatal surgery for lethal and non-lethal conditions and to elucidate characteristics associated with these attitudes. Methods Survey of 1200 paediatric surgeons, neonatologists and maternal–fetal medicine specialists. Results Of 1176 eligible physicians, 670 responded. In the setting of a lethal condition for which prenatal surgery would likely result in the child (...) surviving with a severe disability, most respondents either disagreed or strongly disagreed that they would recommend the surgery. Male physicians were twice as likely to recommend surgery for the lethal condition, as were physicians who believe that abortion is morally wrong. Older physicians were less likely to recommend surgery. For non-lethal conditions, most respondents agreed that they would recommend prenatal surgery, even if the surgery increases the risk of prematurity or fetal death. Compared with MFMs, surgeons were less likely to recommend such surgery, as were physicians not affiliated with a fetal centre, and physicians who were religious. Conclusion Physician’s attitudes about prenatal surgery relate to physicians’ beliefs about disability as well as demographic, cultural and religious characteristics. Given the variety of views, parents are likely to receive different recommendations from their doctors about the preferable treatment choice. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. An establishing circumstance of the ' restoration ' of Christian philosophy at the end of the last century, and the turn of this century, was that the medieval authors whom Christian philosophers turned to were, by profession, theologians whose appropriation of philosophy was for explicitly theological ends. By and large, however, the modern authors who set about retrieving medieval thought had an agenda quite different from that of their medieval luminaries. Still reeling from the philosophical fall-out of the Enlightenment, and encountering rationalism, idealism, and empiricism on all sides, committed Christian thinkers sought a source of philosophical reflection and, perhaps more importantly, justification, that could buttress the claims made by Christianity for those who were within the believing community, and defend the faith from the intellectual attacks of those who were not. The enduring philosophical inheritance of the Middle Ages, and particularly the philosophia perennis of St. Thomas Aquinas, was that source, wrote Leo XIII in his Aeterni patris, and Catholic philosophers soon collected. But the inheritance was not fully collected. With distinctive philosophical goals in mind, Christian philosophers focused upon the putative philosophy of medieval writers, particularly Aquinas, and largely left theological reflection alone. And, when theological contentions on the part of medieval authors did make their way into the discussion, they were almost inevitably appropriated as a legitimate incorporation of revealed teaching into what somehow remained the philosophical project. The result was 'Christian Philosophy.' Although this resulted in the flurry of Catholic philosophical study during the first half of this century, the picture that emerged of the medieval authors, and of Thomas in particular, was inevitably one-sided, and incomplete. An overly pessimistic assessment of the situation would be to say that, for all the hard work of the Gilsons and Maritains, Van Steenberghens and DeKonincks, we are no nearer to Thomas today than we were in the 1870s. BOOK REVIEWS 167 Brian Davies's endeavor seeks to change that, because it attempts to provide the modern reader with a comprehensive introduction to the great expanse of Thomas's thought according to the manner in which Thomas himself presented it in his mature theological masterpiece, the Summa theologiae. Fr. Davies has succeeded magnificently, and his book will become, as it should, a mainstay on the bookshelves of university libraries, students, and teachers alike. Professional philosophers whose work never leads them to Thomas's discussion on Christ, say, can readily get a good working knowledge of how Thomas approaches this center of Christian faith and practice. And the student who is altogether new to Aquinas can grasp something of the ' movement ' of Thomas's thought by reading, and re-reading, Davies judicious renderings of Thomas's doctrine on human acts. This is a book of many uses, all of them instructive and helpful. Considering this book to be an introduction, as Fr. Davies does (p. viii), does not do justice to the quantity of his achievement in writing it, or of the student's investment in reading it. The work occupies some 391 pages, reading made difficult by the tightly-knit character of Thomas's thought, though Davies' easy writing helps to allay the burden. The physical constitution of the book, in slightly off-white octavo paper and an 11-point base font, makes for comfortable reading. Davies has avoided excessive footnoting, giving references to Thomas's text judiciously, and he also provides a well-tailored and impressively diverse bibliography at the end.of the volume which can be effectively consulted by his reader. The author himself is a foundational theologian at Blackfriars in Oxford, so one might expect him instinctively to address the particular audience he encounters in his work. What we need is, first, a detailed specification of the range of goods towards which reason directs us, then, an explanation of how reference to these goods is explicit or implicit in those precepts directive of action upon which prudence has to he able to draw (if it is to function in such (...) a way as to break with the otherwise vicious circle), and, finally, an explanation of how in the concrete circumstances of social life the precepts of reason can become effective. The absence of a systematic treatment of goods, which I noticed earlier, therefore turns out to he an important omission from Cessario's account, since without it a crucial part of his argument remains incomplete. What makes this omission all the more disappointing is the excellence of Cessario's subsequent discussion of the relationship of the theological virtues to the intellectual and moral virtues and of how the habitus of nature are enriched and strengthened by the habitus of grace. Teachers of moral theology could reflect on this discussion with great benefit to their students. It is a mark of how very good a hook Cessario has written that it arouses enormous impatience for a sequel which will not only carry the argument further hut also fill out what is missing in the argument so far. When completed, the Opera Omnia will contain not only vast writings on analogy and the nature of philosophy hut also the single most thorough, and arguably most profound, exposition of the Secunda pars of St. Thomas Aquinas's Summa theologiae ever written. The present installment covers qq. 71-85 of the Prima secundae. BOOK REVIEWS 345 Although the Spanish province of the Dominican Order has taken over the publication and distribution of Ramirez's Opera Omnia from the Consejo Superior de lnvestigaciones Cientificas, who began the series and oversaw the publication and distribution of all previous volumes, the new volumes' physical constitution is identical to that of the earlier volumes, since the actual printing is done at the same house. The volumes read easily, not only because they are in octavo form, hut also because the publishers have done the printing on an off.white paper, with leisurely spacing of the 11 point type. The second volume contains four indices: an index of names, biblical references, references to Thomas's writings, and a schematized index of the contents of both volumes. In a project of this magnitude one is prepared to find printing mistakes, and there are occasional typographical errors and formatting errors such as mis-italicization. In one place there is an omission of an entire line. (In vol. 2, p. 537, no. 373, the citation from Innocent III, after the words ' visionis Dei,' should be completed with the following: " (= damni tantum), actualis vero poena peccati est gehennae perpetuae cruciatus.") But these are minor imperfections, and the editor Fr. Rodriguez once again deserves our thanks for making such learning tools available to us in so useful a format. Rodriguez has informed me that the next volume to appear will be De gratia in 1991, despite the fact that a treatment De lege would of course be in keeping with the order of the Prima secundae. Recent experimental work offers evidence that infants become aware of suffixes at a remarkably early age, as early as 6 months for the English suffix -s. Here, we seek to understand this ability though the strategy of computational modeling. We evaluate a set of distributional learning models for their ability to mimic the observed acquisition order for various suffixes when trained on a corpus of child-directed speech. Our best-performing model first segments utterances of the corpus into candidate words, thus populating (...) a proto-lexicon. It then searches the proto-lexicon to discover affixes, making use of two distributional heuristics that we call Terminus Frequency and Parse Reliability. With suitable parameter settings, this model is able to mimic the order of acquisition of several suffixes, as established in experimental work. In contrast, models that attempt to spot affixes within utterances, without reference to words, consistently fail. Specifically, they fail to match acquisition order, and they extract implausible pseudo-affixes from single words of high token frequency, as in [pi-] from peekaboo. Our modeling results thus suggest that affix learning proceeds hierarchically, with word discovery providing the essential basis for affix discovery. (shrink)

We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. In keeping with his careful and cautious approach, near the end of the book Father de Margerie admits the (...) limitations of Augustine, limitations which Augustine himself often perceived. "First, Augustine's strictly exegetical works are rather limited.... His sustained commentaries are few, those which have reached us concern Genesis, Job, the Letters to the Galatians and part of that to the Romans, the Gospel, and the First Letter of John" (126). Secondly, Augustine had only a slight knowledge of Biblical Greek. He usually worked from the Latin Bible. He seldom referred systematically to the Greek. Further, he had "but a smattering of Hebrew, acquired indirectly through his familiarity with Punic" (126). Finally-a very large admission- "he, along with nearly all the Fathers, failed to analyze adequately the literal meaning of numerous texts he sought to interpret" (126). In spite of such limitations, Augustine and the other Fathers do provide us with many insights into sound doctrine. This is especially useful since so many of the errors of today, advertised as new, are merely ancient mistakes rejected centuries ago by the Fathers. Therefore we are all indebted to Father de Margerie for helping to call us back to what is so very good in the Fathers. Father de Margerie has rendered a singular service to scholarship in his first two volumes of study of Patristic exegesis. The present volume, the third, is a worthy successor to the first two. Pp. x + 148. Drawing from the virtue-ethics orientation of his earlier work, Friendship and the Moral Life (Notre Dame: University of Notre Dame Press, 1990), Paul Wadell has written two books that seek to accomplish two distinctly different BOOK REVIEWS 509 objectives: to produce a work that can serve as a general introduction to Thomas Aquinas's teaching about ethics, and to produce a monograph that urges a different approach to the interpretation of Thomas's ethical teaching. But both books share a common interest of Wadell's: showing that Thomas's ethics is an ethics of genuine affection. Whether he is judged to have reached the two objectives is a question that is likely to be answered differently by moralists, depending upon the issues and approaches that shape their own understanding of Thomistic moral theology. At the very least, Wadell has produced two well-crafted books that are trend-setting works in a long and promising career, works whose approach is surely to become familiar as more and more writers emphasize virtue ethics with regard to the moral teaching of Aquinas. And at most, Wadell has shown himself to be both a fine teacher of Thomas's ethical thought and an incisive scholar in identifying the subterranean movements of the Common Doctor's thought. I shall consider The Primacy ofLove first, which, although it appeared second, is a good intelligible backdrop for presenting the more sophisticated and important argument of Friends ofGod. Waddell's introduction to Thomas's ethics is not really a synopsis of the Secunda pars of the Summa theologiae, though the lion's share of the material he employs is from there, and in something of its original order. It is rather a sympathetic, almost affectionate, portrait of Thomas's ethical teaching. The book does not introduce the reader to the technicalities of Thomas's thought, or to the bewildering debates surrounding the practical syllogism and natural law that have characterized the secondary literature in the second half of this century. The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. Hal Draper was born in Brooklyn in 1914, to East European Jewish immigrant parents. In 1932 he became active in the Student League for Industrial Democracy and the Socialist Party youth section, the Young People's Socialist League. A leader of the Student Strikes Against War, he became an associate editor of Socialist Appeal in 1934. In 1937, the socialist youth, led by Draper and Ernest Erber, voted to support the Fourth International after Trotsky's followers entered the Socialist Party. Draper opposed (...) the subsequent split in the SP, which Trotsky and James P. Cannon deliberately provoked, but left with the Trotskyists and became the national secretary of the Socialist Workers’ Party's youth group, a member of its first National Executive, and the secretary of the party's National Education Department. Irving Howe, a YPSL comrade, later recalled his admiration. Draper was, ‘genuinely learned in Marxism, with a mind that marched from one theorem to another as if God were clearing his way’, a youth leader who ‘would speak for us with a razored lucidity’ in debate with the Stalinists. Draper was part of the minority when the SWP split in 1940 over two issues, the ‘Russian question’ and the ‘bureaucratic conservatism’ of James P. Cannon's internal party regime. Draper became a founder member of the Workers’ Party, led by Max Shachtman, which developed an analysis of the Soviet Union as neither a ‘workers’ state’ nor state capitalist but a new form of exploiting class society, bureaucratic collectivism. The WP refused to ‘defend the Soviet Union’ and developed a distinctive democratic revolutionary Marxism, summed up by the slogan, ‘Neither Washington nor Moscow but the Third Camp of Independent Socialism!’. And, in reaction to Cannon's monolithic conception of the party, the WP developed a highly democratic internal political culture marked by ‘an atmosphere of genuine tolerance’ unceasing internal debate carried in the public press, and untrammelled rights for minorities. In lieu of an abstract, here is a brief excerpt of the content:NIETZSCHE AND MIMESIS by Mark P. Drost The phenomenon of imitation as it operates in Nietzsche's dieory of ecstasy is the central and most important element in his theory of tragedy and art in general. In Nietzsche's vision oftragedy we see diat this ecstasy is not limited to the individual artist, but it infects the tragic chorus and the spectators as well. Nietzsche's reinterpretation of the concept of (...) imitation is presented through the Apollonian and Dionysian artistic impulses which express themselves as distinct tendencies in die arts. In order to understand Nietzsche's concept of imitation one must trace the artwork back to the artist whose activity is an imitation of the Apollonian or die Dionysian state. The fusion of these artistic impulses in their highest development occurs in the chorus. The ecstatic impulse of the chorus results in a paradoxical act of self-displacement: a vision which exceeds the boundaries of the stage and diminishes die distance which is normally secured through the theatrical conventions of distance. We shall see how Nietzsche's vision oftragedy can be understood as a reinterpretation ofthe classical concept of imitation by contrasting it with Aristotle's theory. The classical concept ofart as imitation (mimesis) is best expressed in die Poetics ofAristotle. Under the term "mimesis" there is included an array of artistic activity, e.g., epic poetry, "the poetry of tragic drama, and, moreover comedy and dithyrambic poetry, and most flute-playing and lyre-playing" (1447al4). Since tragedy has its roots in poetry, the causes from which tragedy arises are similar to (if not identical with) the causes from which poetry arises. Poetic imitation itself appears to have two causes. First, imitation is natural to man from childhood (1448b2). Man is the most mimetic of creatures, and in childhood he learns by imitating the 309 310Philosophy and Literature people, diings, and events around him. Second, because he learns through them, man takes delight in seeing die images of things and recognizing that they are imitative. Since the pleasure of such recognition is so great, one can in fact take delight in seeing images ofthings which are painful to see in their original (1448b12). The former cause yields pleasure from the knowledge of the original while die second cause yields pleasure because one knows it is not an original. Thus the knowledge that what is being witnessed is an imitation is required for the mimetic pleasure to be experienced. Ifone has not seen the original, the pleasure one experiences is somediing different from die pleasure one takes in imitation (1448b6). It is not that imitation can never merely reproduce or copy its original in the manner of a perfect imitation, but artistic imitation requires that diere always be a sufficient difference between the representation and the original to allow for knowledge and die mimetic pleasure subsequent to it. The paradox of imitation is this: the more perfect the imitation is, the less it is known as a work ofimitation. In general, the greater die degree of the realism ofthe imitation, the greater is the need for some indication that it is art and not reality. With respect to this Arthur Danto says, "Mimesis itself, providing diat the conventions of dislocation are clear to the audience, in fact inhibits just those beliefs that would be activated widiout those conventions."1 The spectator could not obtain mimetic pleasure from the "perfect imitation" if the illusion it generated were so effective as to render the artistic medium completely transparent. The causes of mimetic pleasure are die fact diat one is presented widi an imitation and that one is aware of die difference (and/or similarity) between an object and its representation dirough an artistic medium which is never completely transparent. Although by perceiving an imitation we learn of the thing imitated, it is not essential to die concept ofimitation that there actually and empirically exist an original event or figure which explains the content of die imitation. Though the concept ofimitation is a relational concept, it is not so in the sense that there must be an originally existing personage or state ofaffairs against which we may measure the accuracy ofme mimetic representation. It has no mass; it has no color; it has no physical properties at all, except for spatio-temporal location. It is a fine example of what Hans Reichenbach would call an abstractum. It is a purely abstract object. It is, if you like , a theorist's fiction. It is not one of (...) the real things in the universe in addition to the atoms. After a few preliminary remarks concerning Martin's working model, we focus the majority of our commentary on the notion of “consensus,” which is at the heart of her “ethical consensus method,” and the three approaches from which it is drawn. At the outset of this chapter, I want to echo the praise offered by all of the contributors to this volume for Finder’s outstanding, thoughtful and self-critical narrative of the case of 83 year old Mrs. Hamadani and her fiercely devoted children. The brocade account is carefully woven, like a fine Persian tapestry, to convey the rich complexity of an actual ethics consultation as it transpires not over hours, but rather over days, weeks, months and even, as in this case, (...) years. Mrs. Hamadani’s narrative so told is replete with questions worthy of critical reflection. What is an appropriate role for ethics consultation in healthcare? How can an autonomy-centric culture accommodate community-centric cultural difference? How can or should the voice of the patient be heard when she cannot speak for herself and the much louder and anguished voices of others demand to be heard? What are the bounds of acceptable medical treatment and how should care teams respond when patient or family demands threaten to push care givers to cross those bounds? What is an appropriate response for ethics consultants when they are asked to take over a case or prevent a colleague from interacting with an unwilling family? Do the motivations of patients, family, or members of the care team in calling ethics consultants necessarily shape the consultant’s role? And so the list goes on, as the variety of commentaries which comprise the majority of this volume, as well as the multitude of discussions that you, the readers, will inevitably have with colleagues, students, and friends make abundantly clear. In this book, Peter Vickers argues that inconsistency in science has been massively exaggerated by philosophers. In his view, inconsistent science is neither as rampant nor as damaging as many have supposed. To argue his point, he develops a specific method he calls theory eliminativism and applies it to four case studies from the history of physics and mathematics .The method is original and convincing, and the case studies well researched and compelling. The crisis in donor organ and tissue supply is one of the most difficult challenges for transplant today. La aplicación de la versión tradicional –estructurada en cuatro partes– de la doctrina católica del doble efecto a dos casos de conflicto materno-fetal –la histerectomía en el caso de cáncer de útero, y la craneotomía en el caso de parto obstruido–, ha originado cierta confusión entre los partidarios de las versiones –estructuradas en dos partes contemporáneas– del doble efecto. Aunque la craneotomía, no la histerectomía, fue prohibida de acuerdo a la DDE tradicional, pocos partidarios de las versiones contemporáneas de la (...) DDE consideran que estos casos sean significativamente diferentes. ¿La aplicación tradicional de la DDE a estos dos casos puede entenderse? Si así es, ¿esta aplicación sorprendente puede arrojar luz a los debates contemporáneos sobre el doble efecto? Este artículo trata estas dos preguntas. Se divide en tres apartados: en el apartado I se ofrece una panorámica sobre la génesis histórica –en la casuística católica romana– de las versiones de la DDE articuladas en cuatro partes; en el apartado II se discute las aplicaciones habituales de la DDE tradicional en cuatro partes a una serie de casos, y se presta una atención particular al análisis ortodoxo de los dos procedimientos de aborto terapéutico mencionados, la histerectomía y la craneotomía. Tras exponer tres concepciones de la acción intencional, la tomista, la davidsoniana y la goldmaniana, se muestra que desde ninguna de ellas esos casos pueden distinguirse en virtud de la intención; en el apartado III se lleva a cabo un análisis de lo que se denomina el principio de prioridad causal, que da sentido a la aplicación tradicional de la DDE a estos y otros casos. El artículo concluye explicando por qué se pensó que las tres primeras condiciones de la DDE tradicional, que se reducen a una en las versiones modernas del doble efecto, estaban relacionadas pese a ser diferentes. Por último, sugiero que los desafíos que propiciaron el desarrollo del principio de prioridad causal aclaran otros desafíos similares que deben ser afrontados por cualquier versión moderna adecuada del doble efecto. Presenilin‐1 (PS1) is thought to regulate cell differentiation and survival by modulating the Notch signaling pathway. Mutations in PS1 have been shown to cause early‐onset inherited forms of Alzheimer's disease (AD) by a gain‐of‐function mechanism that alters proteolytic processing of the amyloid precursor protein (APP) resulting in increased production of neurotoxic forms of amyloid β‐peptide. The present article considers a second pathogenic mode of action of PS1 mutations, a defect in cellular calcium signaling characterized by overfilling of endoplasmic reticulum (ER) (...) calcium stores and altered capacitive calcium entry; this abnormality may impair synaptic plasticity and sensitize neurons to apoptosis and excitotoxicity. The calcium signaling defect has also been documented in lymphocytes, suggesting a contribution of immune dysfunction to the pathogenesis of AD. A better understanding of the calcium signaling defect resulting from PS1 mutations may lead to the development of novel preventative and therapeutic strategies for disorders of the nervous and immune systems. In this article I develop a model of theoretical understanding in science. This is a philosophical theory that specifies the conditions that are both necessary and sufficient for a scientist to satisfy the construction ‘S understands theory T ’. I first consider how this construction is preferable to others, then build a model of the requisite conditions on the basis of examples from elementary physics. From his earliest work on personal identity to his last on the value of truthfulness, the ideas and arguments of Bernard Williams - in the metaphysics of personhood, in the history of philosophy, but especially in ethics and moral psychology - have proved sometimes controversial, often influential, and always worth studying. This book provides a comprehensive account of Williams's many significant contributions to contemporary philosophy. Topics include personal identity, various critiques of moral theory, practical reasoning and moral motivation, truth and (...) objectivity, and the relevance of ancient Greece to modern life. This paper argues that the type of conscience claims made in last decade’s spate of cases involving pharmacists’ objections to filling birth control prescriptions and cases such as Ms. Means and Mercy Health Partners of Michigan, and even the Affordable Care Act and the Little Sisters of the Poor, as different as they appear to be from each other, share a common element that ties them together and makes them fundamentally different in kind from traditional claims of conscience about which (...) a practical consensus emerged in the 1980s and 1990s. This difference in kind is profoundly significant; so much so, we contend, that it puts them at odds with the normative basis for protecting conscience claims in United States health care settings in the first place, making them illegitimate. Finally, we argue that, given the illegitimacy of these contemporary claims of conscience, physicians and other health professionals must honor their well-established standing obligations to provide informed consent and refer or transfer care even if the service requested or needed is at odds with their own core moral beliefs—a requirement that is in line with the aforementioned practical consensus on traditional claims of conscience. In “Consensus, Clinical Decision Making, and Unsettled Cases,” David M. Adams and William J. Winslade make multiple references to both editions of the American Society of Bioethics and Humanities (ASBH) Core Competencies for Healthcare Ethics Consultation in their discussion of two assumptions that are supposed to be at the heart of the facilitated consensus model’s inability to handle unsettled cases; that is, that:1. Consultants “should maintain a kind of moral impartiality or neutrality throughout the process,” “explicitly condemn[ing] anything resembling a (...) substantive ‘ethics’ recommendation,” and2. “What counts as the proper set of allowable options among which the parties are to deliberate will itself always be clearly discernible.”Herein, I argue that neither of these assumptions is required by ASBH’s ethics facilitation approach. I then conclude by suggesting that, despite their fundamentally mistaken interpretation of the ASBH approach—perhaps even because of it—Adams and Winslade have made two important contributions to the ethics consultation literature. The vast majority of extant empirical research examining the relationship between corporate social performance and financial performance selects samples of only those firms which are observed engaging in CSP. In this study, the authors assert that firms’ efforts to pursue CSP and subsequently their appearance in social-choice investment advisory firms’ ranking databases are non-random. Studying the CSP–FP link using selected samples of only those firms whose social performance is ranked by SIA firms introduces a sample-selection bias which limits generalization of (...) results to a population of all firms, and at worst provides alternate explanations for observed relationships. The authors test these assertions on a large sample of public corporations in the United States over 6 years and find a sample-selection bias. Upon correction of this bias, this study confirms the positive impact of CSP on FP. (shrink)

Stories of firms that exceed local compliance requirements in their environmental performance appear routinely. However, we have limited theoretical explanations of what propels these firms to exceed compliance. Our theory suggests that global competitive and institutional pressures lead multinational firms to develop highlevel, environmental management systems (EMS) that make them more competitive. For economic and other reasons, select firms make the choice to rationalize their collective environmental performance to the highest common denominator rather than the lowest. Regulations around the world (...) differ widely and are a moving target in many settings. The need to comply with such myriad, shifting rules leads to firms creating EMS to help stay ahead of regulations worldwide. Using institutional and internationalization theories as our basis, we offer a propositional model concerning global competitive/institutional pressures and their effects on corporate environmental performance.
